2.4 Information We Collect on Behalf of Clients

As a digital marketing agency, we may process personal information as a service provider/processor on behalf of our clients (e.g., managing a client’s email list, ad retargeting audiences, or CRM data). In those cases, our clients’ own privacy policies govern how that data is used, and we process it under contractual instructions from the client. If you have questions about how a specific business collected your data through an ad or campaign we managed for them, please contact that business directly.

3. How We Use Information

We use collected information to:

  • Provide, operate, and improve our Services and Site

4. How We Share Information

We do not sell your personal information for money. We may share information with:

  • Service providers/vendors: hosting companies, CRM and email platforms, analytics providers, ad platforms (Google, Meta, LinkedIn, etc.), payment processors, and other vendors who perform services on our behalf under contractual confidentiality and data protection obligations.
  • Clients: when we manage advertising or marketing on behalf of a client, relevant campaign and lead data may be shared with that client.
  • Legal and safety reasons: to comply with a subpoena, court order, or other legal process; to enforce our agreements; or to protect the rights, property, or safety of our company, clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of business assets.
  • With your consent: for any other purpose disclosed to you at the time of collection.

“Sale” and “Sharing” for Targeted Advertising Purposes

Under laws like the Texas Data Privacy and Security Act (TDPSA) and California’s CCPA/CPRA, the use of tracking pixels and cookies to enable third-party targeted advertising (e.g., Meta Pixel, Google Ads remarketing tags) can be considered a “sale” or “share” of personal information, even without an exchange of money. See Section 9 (Your Privacy Rights) for how to opt out.

5. Legal Bases and Applicable Laws

We aim to comply with applicable privacy and marketing laws, including:

  • Texas Data Privacy and Security Act (TDPSA) — effective July 1, 2024, governing the collection and processing of Texas residents’ personal data.
  • Texas Business & Commerce Code provisions on data breach notification (Ch. 521) and data broker requirements, where applicable.
  • California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA) — for California residents, if applicable to our client base or visitors.
  • CAN-SPAM Act — governing commercial email communications.
  • Telephone Consumer Protection Act (TCPA) — governing calls, texts, and autodialed/prerecorded marketing communications.
  • Children’s Online Privacy Protection Act (COPPA) — our Site and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
  • CAN-SPAM and state “junk fax” analogs, where applicable to client campaigns.
  • General Data Protection Regulation (GDPR) — if we process personal data of individuals located in the European Economic Area (EEA) or UK on behalf of clients or through our Site.
  • Other applicable U.S. state privacy laws as they take effect (e.g., in states such as Colorado, Connecticut, Virginia, Utah, Oregon, and others with comprehensive privacy statutes), to the extent our processing activities fall within their scope.

This Policy is intended to give you meaningful information about our practices; it does not itself create additional legal rights beyond what applicable law provides.

6. Cookies and Tracking Technologies

We and our vendors use cookies, web beacons, pixels (including the Meta/Facebook Pixel and Google Ads/Analytics tags), and similar technologies to:

  • Recognize your browser/device across visits
  • Measure and attribute the performance of ad campaigns
  • Build retargeting/remarketing audiences on ad platforms
  • Analyze Site traffic and usage patterns

You can control cookies through your browser settings, and many browsers let you block or delete cookies. Blocking cookies may affect Site functionality. Where required, we will present a cookie consent banner allowing you to accept or reject non-essential cookies before they are set.

We do not currently respond to “Do Not Track” browser signals except where required by law (e.g., recognizing the Global Privacy Control signal as an opt-out request under CCPA/TDPSA, where applicable).

7. Data Retention and Security

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce agreements.

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

In the event of a data breach affecting Texas residents’ sensitive personal information, we will provide notification as required under Texas Business & Commerce Code § 521.053 and other applicable breach notification laws.

8. Marketing Communications (Email, Text, and Calls)

  • Email: Marketing emails we send comply with the CAN-SPAM Act, including providing a clear way to unsubscribe in every commercial email. You may opt out at any time using the unsubscribe link or by contacting us directly.
  • SMS/Text and Calls: We only send marketing texts or place marketing/autodialed calls to numbers where we have obtained the consent required under the TCPA. You may opt out of texts by replying “STOP” or of calls by requesting removal from our call list.
  • Client Campaigns: If we manage email, SMS, or call campaigns on behalf of a client, the client is responsible for ensuring proper consent was obtained from their contacts, and we operate as their service provider in executing those campaigns.

9. Your Privacy Rights

Depending on your state of residence, you may have the right to:

  • Know/Access what personal information we have collected about you
  • Correct inaccurate personal information
  • Delete personal information we hold about you
  • Opt out of the “sale” or “sharing” of personal information for targeted advertising purposes
